Conditions and guarantees for your online purchase
1.- SCOPE OF GENERAL CONDITIONS OF PURCHASE
These General Conditions of Purchase (the "General Conditions" or the "GTC") together, where applicable, with any special conditions that may be established, shall expressly regulate the relations arising between "SAN CRISPIN, S. COOP." (with registered office at Avda. de la Industria, nº 5-6, 07730 ALAIOR (ILLES BALEARS) and N.I.F. nº F-07013517. Registered in the Register of Cooperatives of the Balearic Islands, and the customers who contract the products and services (the "Customer" or "User") offered through the online shop available in the Online Purchase section (the "Online Shop") of the website "S.COOP". www.sancrispin.es www.sancrispin.net (the “Web Site”).
The Products offered in the Online Store are aimed solely and exclusively at natural persons of legal age, defined as "consumers" or "users" in Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws ("Consumers and Users Law"). Consequently, the Products offered through the Online Store may not be purchased by minors, other supermarket chains, self-service stores, department stores, wholesalers, distributors, intermediaries and other professionals in the food sector.
A User is a person registered on the Website. Once the User places an order ("Order") and completes this Order, the User acquires the status of Customer.
3.- SERVICE AVAILABILITY
The range of products offered in the SAN CRISPIN online shop is geographically limited. Therefore, during the purchase, the application asks the user to select the delivery address of the order, indicating, if necessary, that the address is not among the possibilities of SAN CRISPIN's online sales, or allowing the application to continue with the purchase process.
4.- FORMALISATION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF PURCHASE
The information contained in these terms and conditions and the details contained in this website do not constitute in themselves an offer to sell but an invitation to contract. No contract shall exist until the order is expressly accepted by SAN CRISPIN.
The making of a purchase in the Online Shop shall require the acceptance, in full and without reservation, of the GTC, as well as of the particular conditions which, where applicable, govern the purchase, in the following terms:
The first time a registered User makes a purchase, he/she must check the corresponding acceptance checkbox. The following times the checkbox will be pre-checked, unless the GTC have been modified, in which case the User will be notified that there have been changes to the GTC and the registered User will have to check the checkbox again as a sign of acceptance.
The online shopping service is available for minimum purchases of €50.
When purchases are in the municipalities of Es Migjorn Gran, Alaior, Es Mercadal and Ferreries (Menorca, Balearic Islands) for purchases of less than sixty-five euros (65 €), the customer must pay a fixed delivery charge of five euros (5 €), which the buyer must pay along with their purchase, so that their order can be processed and delivered, and which includes all concepts related to the preparation of the order, its handling, bagging, transport and delivery to the customer's home.
For purchases of an amount equal to or greater than sixty-five euros (65 €) and which are delivered in the municipalities of Es Migjorn Gran, Alaior, Es Mercadal and Ferreries (Menorca, Balearic Islands) the delivery charges will be FREE. As well as in the case of STORE COLLECTION (CLICK AND COLLECT).
When purchases are in the rest of the municipalities of Menorca (Balearic Islands) for purchases of less than one hundred euros (100 €), the customer must pay a fixed delivery charge of five euros (5 €), which the buyer must pay along with their purchase, so that their order can be processed and delivered, and which includes all concepts related to the preparation of the order, its handling, bagging, transport and delivery to the customer's home.
For purchases, whose amount is equal to or greater than one hundred euros (100 €) and that are served to the rest of the municipalities of Menorca (Balearic Islands), shipping will be FREE. As well as in the case of STORE COLLECTIONS (CLICK AND COLLECT).
In any case, when the buyer does not agree with the price of the shipping costs, the purchase process cannot be continued and, therefore, it will not be completed, without the order being processed, and the order will be cancelled in the state in which it was found.
6.- PRODUCTS AND PRICES
SAN CRISPIN offers a wide and varied assortment of products in its Online Store, for which the price and characteristics (the "Product(s)") will appear on the screen. SAN CRISPIN informs you that the images of the Products that the User can view in the Online Store are shown for identification and descriptive purposes only, and may differ from those finally delivered to the Customer.
SAN CRISPIN guarantees the existence of all the products offered in the Online Store, although, from time to time, it may not guarantee the availability of the same for all Users and in the volumes required by them at the time of placing the Order. In the event that at the time of delivery of the Order, SAN CRISPIN does not have any of the products selected by the Customer, it will proceed to telephone the customer to offer him/her the possibility of ordering another product or, on the contrary, to deduct said product from the Order and deduct the price thereof from the final amount of the Order. To do this, the customer must have indicated the possibility of being called on the site provided for this purpose on the Online Store page.
SAN CRISPIN guarantees that the Products supplied through the Online Shop meet the highest standards of freshness and quality. SAN CRISPIN also informs the Customer that the Products will be transported in boxes suitable for each type of Product, in isothermal conditions.
SAN CRISPIN guarantees the Customer the price of the day on which the purchase was made, regardless of the day on which delivery is made, so that the Customer can take advantage of all existing offers at the time of placing their orders, without prejudice to the fact that, at the time of delivery, such offers may not be in force.
On the other hand, in the event that the price of the Products is determined by the price per kilogram or the price of the product is an estimate based on the average weight of the same, as the purchase method is by units, the final price will depend on the actual weight of the product supplied. For this reason, the purchase price may differ from the amount of the Order due to the existence of products of variable weight in the delivery.
SAN CRISPIN informs you that there are limits on the amounts and quantities of purchases made in the Online Store, being more specifically the following: (i) The total final amount of the purchase ticket may not exceed ten thousand euros in any case, so there is a maximum of nine thousand nine hundred and ninety-nine euros per purchase ticket; (ii) A limit of units per product: there is a maximum limit of units that for each product (with the same reference code) may be purchased in the Online Shop, this amount may vary depending on each product, and no more product units may be purchased than those that the Online Shop system itself, at the time of indicating the quantities of product that you want to add to the cart, has enabled; (iii) Without prejudice to the above limit, there is a maximum amount that the Customer may purchase for each product of one thousand euros, i.e. no more than one thousand euros may be purchased for a single product, regardless of whether or not the limit on the number of units purchased for the same product has been exceeded.
7.- PURCHASE AND PAYMENT PROCEDURE
7.1.- Pre-registration contract
In order to place an order in the Online Store, the User must first register through the "Register" section of the Website by filling in the form provided. Registration is free of charge.
The online shop can be accessed according to three profiles:
- Partner-customer: the data from the SAN CRISPIN database will be integrated, and the user will have to generate his own password.
- Non-member-customer: registration as a user of the online shop only. Being a member-customer is optional, it is not a purchase requirement.
- Visitor: browsing the website, no purchases can be made under this profile.
- Currently, the Online Shop does not allow registration as a Member-Customer in the name of a legal entity, with the exception of being able to request invoices for purchases made by a natural person in the name of a legal entity.
Once the User has registered, he/she must complete the "My Details" section.
The user name and password are personal and non-transferable data of each User and must be under the custody of the User, so it is expressly forbidden to communicate them or facilitate their use to third parties.
In order to prevent third parties from knowing them, Users shall refrain from writing down these passwords in notebooks, wallets, papers, post-it notes, etc., and it is preferable to memorise them.
If the User has indications or certainty that another person knows his/her identification details and password, he/she must change his/her password, requesting a new one in the "My User" section, by clicking on "Change password". For its part, SAN CRISPIN reserves the right to cancel the registration in the event that it detects fraudulent use of the same.
SAN CRISPIN informs you that both the collection of your data and the display on the Website will be transmitted via a secure connection, encrypted and protected according to SSL protocol (Secure Socket Layers).
7.2.- Purchasing procedure
The Customer may shop online 24 hours a day, 7 days a week, 365 days a year (366 days in leap years).
The User may access the Online Shop and place an order ("Order"). If the Order is completed, the registered User acquires the status of Customer.
Once the User enters the Online Store and has previously registered, the User can place an order. Before placing the order, he/she will be asked to enter the postcode of the point where he/she wants the order to be delivered (which may be different from his/her usual place of residence). Then, the available Products will appear on the screen, with their characteristics, photos and prices, ordered by sections, prices or brands, depending on the User's needs. The User will be able to add the chosen products by clicking on the "Add" button located under each Product. In the right-hand section of the "Your cart" screen, the User will be able to view the contents of the Order. Once the Order has been completed, the User must select the "Buy" option, visible under "Your cart", and the available delivery schedule will be displayed on the screen. The User must select, among those available, a day and time slot for the delivery or collection of the Order. Finally, the User will proceed to pay for his/her purchase, for which he/she must follow the instructions that appear on the screen.
The Customer is informed that the Order will be charged to their credit or debit card as soon as it is ready.
7.3.- Payment methods
To proceed to payment, the User must follow each and every one of the instructions that appear on the screen, being able to use the means of payment indicated in the Online Store at all times.
The user will not be able to make the payment with the "SAN CRISPIN" card. However, as soon as the payment system using this card is operational, the user will be duly notified, these terms and conditions will be modified and the operation will be enabled to make payment using this card.
In any case, the use of coupons or discount codes may be subject to specific conditions due to their content, the product to which they refer, the condition of the person using them, etc., which will in any case be communicated to the User during the purchase process and which must be fully complied with in order to use the corresponding coupon or discount code.
In the event that the user is a client member, he/she may redeem his/her gift vouchers in his/her online purchase, selecting the voucher or vouchers that he/she wishes to redeem in his/her purchase.
The payment of the purchase made will be made at the time of issuing the simplified invoice (also known as "tiquet"), in such a way that when the order leaves the dispatch centre to the delivery address indicated by the customer, it will already be paid. If, at a later date, any incident should arise in the delivery that totally or partially prevents it from being delivered, the customer will receive a total or partial credit for the amounts corresponding to the product or products that could not be delivered.
7.4.- Documentary confirmation
Upon completion of the Order by the Customer, he/she will be able to view on his/her computer screen and/or print the verification of the order and the order confirmation number. Without prejudice to the foregoing, SAN CRISPIN will proceed to send justification of the contracting carried out, with all its terms, by electronic means to the e-mail address indicated at the time of registration, and within a period not exceeding twenty-four (24) hours from the completion of the Order by the Customer.
8.- DELIVERY AND COLLECTION
8.1.- Geographical coverage
The online purchase service will only be available in Menorca.
8.2.- Delivery or collection schedule
Home deliveries will be made from Monday to Friday, except for national, regional and local holidays, in those time slots which, at the time of placing the Order, are available and have been selected by the Customer. Likewise, deliveries will also be made on days that are legally authorised for commercial opening.
At the time of placing the Order, the Customer will be able to view the available calendar.
8.3.- Shipping or delivery costs
Order preparation, packaging, handling, transport and delivery shall be free of charge or at a corresponding cost, in accordance with the provisions of the general terms and conditions.
8.4.- Method of delivery
In the "My Details" section, the Customer may select the option for the Order to be delivered to the address indicated at the time of registration in the Online Store, in those towns and/or postcodes where the Online Store service is available.
The Order will be delivered on the day and in the time slot chosen by the Customer, among those available, at the time of placing the Order.
At the time of delivery of the order, the Customer must sign the delivery note (which may be in electronic format), as a sign of conformity and acceptance. This signature may be made by physical means or by tablet, Smartphone or similar electronic system.
The customer may exercise his right of withdrawal under the following terms:
- Non-perishable products: the customer will have a period of fifteen (15) calendar days from the date of delivery to exercise their right. To do so, they must go to one of the SAN CRISPIN supermarkets and hand the product or products they wish to return or exchange for another of the same characteristics together with the purchase receipt. SAN CRISPIN provides you with the possibility of requesting a return through the "My returns" section of the Online Store during the first seven days of the total period for exercising your right.
- Perishable products: within seventy-two (72) hours from the time of delivery.
- The return will always be free of charge for the customer.
- SAN CRISPIN will refund the amount immediately and in the same form of payment in which the purchase was made, respecting the retail price of the purchase regardless of when the refund is made.
10.- RESPONSIBILITIES AND GUARANTEES
The Registered User or Customer shall be responsible for:
- All acts that contravene the provisions of these GTC, the law, morality, generally accepted customs and public order.
- Any act performed in a manner different from that which SAN CRISPIN, through the Online Store, designates in its indications or instructions on the operation and use of the Products.
- The use you make of the Products purchased, exonerating SAN CRISPIN from liability for any damage that may be caused by any incorrect use and/or handling of the Products.
- The certainty, accuracy, validity and timeliness of the data with which you fill in each of the forms that SAN CRISPIN requires.
- The direct or indirect damages that have been caused by any third party if the registered User or Customer lost, disclosed, neglected or, in any way, let for reasons attributable to him, that a third party knew his personal data necessary for the purchase of the Products.
In no event will SAN CRISPIN be liable for:
- Damages of any kind that may be caused to users by the interruption, termination or dysfunction of the Online Store, for reasons not attributable to SAN CRISPIN.
- Misuse or mishandling of the Products by the Customer or a third party, not following the instructions and documentation provided by SAN CRISPIN and/or with the Product.
The Product Warranty conditions shall be established in accordance with the applicable Law, and in the case of warranties greater than those legally required, as indicated in each case.
11.- MEMBER SERVICES
SAN CRISPIN provides you a Servicio de Atención al Cliente,The website is operative from Monday to Friday, from 9:00 to 14:00, by telephone (number 971 371147) and electronically (firstname.lastname@example.org), which can be contacted in the event of any incident that may arise during the online contracting process.
12.- APPLICABLE LAW AND JURISDICTIONE
The General Conditions shall be governed by the common Spanish legislation, which shall be applicable in all matters not provided for in the same in terms of interpretation, validity and execution.
For any dispute that may arise in the interpretation and application of these General Conditions, both SAN CRISPIN and the Registered Users or Clients expressly submit to the jurisdiction of the Courts and Tribunals of the Balearic Islands, waiving their own jurisdiction if any.
13.- SENDING COMMERCIAL COMMUNICATIONS
No commercial communications will be sent to those users of the Online Store who are not registered as Partner-Customers.
In the case of Member-Customers who access the Online Store, the sending of this type of communication will always be governed by what they have indicated to us with regard to other SAN CRISPIN commercial communications that they may receive as a result of their status as a Member-Customer of the Cooperative.
Without prejudice to the foregoing, and in order to complete the registration process satisfactorily (see section 4.7.1.Registration prior to contracting), you will be sent an e-mail to the address provided in that registration to inform you that you have been correctly registered in the Online Store.
